A spouse on H-4 can apply for a work permit (EAD) if the H-1B worker has an approved immigrant petition (Form I-140) or has been allowed to stay beyond six years because a green card process is underway.

- You apply on Form I-765 with proof of your H-4 status and the I-140 approval or extension.
- You cannot work until you have the card.
- The work permit does not give you a green card by itself.
