Pick your priority date to see the answer. It is on your approval notice (I-797) for the petition, or on your labor certification.
Each month, USCIS announces whether people use the final action dates or the dates for filing chart. Check USCIS before you file. Being before the cutoff is not a guarantee: your case must also be complete and approved. This tool is unofficial and is not legal advice.
A priority date is your place in line for a family or employment green card. For family cases it is usually the day the petition (I-130) was filed. For most employment cases it is the day the labor certification or the petition (I-140) was filed.
Find your category and country column in the monthly Visa Bulletin. If your priority date is earlier than the date shown (or the category says Current), your date is current. This tool does that comparison for you.
The final action date is when a green card can actually be approved. The date for filing is when you may start the application. Each month USCIS announces which of the two charts people should use.
