The short answer
If you fell out of F-1 status, you may ask USCIS to reinstate it, usually within five months of the violation, if it happened for reasons beyond your control or would cause extreme hardship. Talk to your school's DSO first.
What to know
- You apply to USCIS with a school recommendation and proof of your circumstances.
- You generally must be a full-time student or planning to be, and not have worked without permission.
- Approval is not guaranteed. If you do not qualify, you may need to leave and return with a new I-20.
- A qualified immigration adviser can help for serious cases.
