The short answer
If your employer is selected in the H-1B lottery and the petition is approved, you can change from F-1 to H-1B without leaving the U.S. A cap-gap rule may extend your F-1 work permission while the petition is pending.
What to know
- The employer must first be selected in the H-1B registration and then file the petition.
- The petition asks USCIS for a change of status to start on October 1.
- Cap-gap lets eligible students keep working until the H-1B starts. Ask your DSO and employer.
- If not selected, other options exist, such as another OPT, a different degree or another visa.
